Controversy over 100% reservation in jobs: Karnataka government gave decision regarding reservation, companies' statement that there will be loss due to the bill.

On July 16, Karnataka government had announced to give 100% reservation to local people in C and D category jobs of private sector, after which, according to the reports of Chief Minister's Office, a temporary ban has been imposed on it.

The post was removed.

After the announcement of this reservation, on July 17, within 24 hours, the Chief Minister removed the post made on social media regarding 100% quota bill.

In favor of Karnataka's bill, it was said that after passing this bill, it will become mandatory to give reservation to local people in industries, factories and other establishments of Karnataka.

50% of the posts like manager and 75% of the posts in non-management jobs will be reserved for Kannadigas.

 In Group C and Group D jobs, 100% local people i.e. Kannada speakers will get jobs.

Those employed in state institutions will have to pass Kannada proficiency test.

If companies violate the provisions of the law, they may have to pay a fine of 10 thousand to 25 thousand rupees.

Work of non-Kannada population in Karnataka.

The number of non-Kannada employees in Bangalore companies is estimated to be 35% while 20% of the total non-Kannada population works in Karnataka. Most of this population is from North India, Andhra and Maharashtra. A few days ago, there was a long debate in Bangalore about such a large number. Signboards with names written in Hindi were broken regarding this.

So far, 6 states have announced 75% reservation.

Even before this 100% reservation talk, the Karnataka government has talked about reservation in private jobs. Apart from this, Haryana, Jharkhand, MP, Andhra and Maharashtra have also announced similar schemes, but till now it has not been fully implemented in any state.

Such announcements have sometimes been stuck in the court and sometimes work on them has not even started. The Jharkhand government said that from January 2023, it will be mandatory to give jobs to local people in 75% of the posts with monthly salary up to 40 thousand in private companies and this will be applicable to all companies with more than 10 employees, while a fine of 5 lakhs will be imposed for violating it.

Right to equality in the Constitution.

The Supreme Court, in one of its decisions, had stated in Article 15 of the Constitution that 'reservation given on the basis of place of residence will not be a violation of Article 15. Because there is a difference between 'place of birth' and 'place of residence'. Because Article 15 (1) and 15 (2) prohibit any discrimination on the basis of place of birth, not on the place of residence.'

When the Haryana government announced 75% reservation for local people in private jobs, the Punjab-Haryana High Court had stayed it, its case is still pending.

 Law experts say that the court should set a logical limit for reservation so that there is a balance between the rights of both locals and outsiders.
