Supreme Court's refusal in Mathura case: SC refused to stop Mathura Idgah celebration, Muslim side's petition rejected.
The High Court had ordered that the service should be done at Shri Krishna's birthplace-Shahi Eidgah in Mathura. The Muslim community had filed a petition in the Supreme Court against this order, but recently the Supreme Court refused to stay the commissioner's survey and this petition Dismissingly, he said that if there is any problem with the survey then adopt the proper method.
This was the case.
The entire dispute related to the birthplace of Shri Krishna is over 13.37 acres of land in Mathura or the Shri Krishna Janmasthan Temple is built on about 11 acres of land and the Shahi Idgah Mosque is built on 2.37 acres of land. The agreement regarding the land in 1968 has also been cancelled. A demand was made in the petition to remove the Idgah Mosque and give the land to the Hindu side.
High Court's decision.
On Thursday, Allahabad High Court had ordered a commissioner survey regarding this dispute, against which Shahi Idgah Mosque and Sunni Central Waqf Board challenged it virtually in the Supreme Court. And it was said that the Supreme Court should stop the action of the Commissioner Survey and the High Court. Till now the decision of the Supreme Court has been that the action will not be stopped and let it continue for now.
Hindi side claims.
While filing the petition in the court, the petitioners had argued that the agreement made in 1968 was fraudulent and was not legally valid, adding that only 13.37 acres of the disputed land of Shri Krishna Janmabhoomi-Shahi Idgah remained. The Allahabad High Court had accepted this on Thursday and while giving orders in favor of the Hindu side, had asked to appoint a Court Commissioner for the Idgah survey, but when will the survey be done and who will be included in it, all this will be decided in the next meeting to be held in the High Court on December 18. Will be decided in the hearing.
