 Those who are elderly parents and their children want to get the property transferred to their name but doing so forcibly is a crime, this complaint can be made in two ways. First of all, a complaint should be made to the police against that son or daughter and a criminal case will be registered under sections 350, 379, 506 of the Indian Penal Code. Secondly, one can also go to the Welfare Tribunal because for complaints in such cases, there is a special tribunal in every state which works under the supervision of an officer of the rank of Sub-Divisional Officer i.e. SDO, because the complaint has to be submitted in writing to the SDO. While making this complaint, your name, address and other important information have to be written clearly and the children of that elderly person are called during the hearing of the complaint.

 Getting the property transferred to one's name by threatening the parents.

 If someone's son or daughter has threatened their parents and has taken the property in their name and after that they are not taking care of them or have thrown them out of the house or do not give them food, then also the Welfare Tribunal helps the senior citizen. Along with this, elderly parents can also take back their property because the High Court has ruled in their favor regarding this right of the parents.

 Madras High Court, while ruling in favor of the parents in one of its cases, said that if the parents feel that they have kept their children without love and respect, then they can unilaterally cancel the Will of the property named in the name of the children. Can take back.

 What is Senior Citizen Act?

 In 2007, this Act was implemented for the protection of senior citizens and under this, the elderly have been given the right to financial security, medical security, maintenance (living expenses) and protection. If parents give property to their children and then the children do not take care of their parents, then in this situation the elderly can take help of the Senior Citizen Act. Under this Act, the elderly can live with peace and dignity in old age, which is a right also given in Articles 41 and 46 of the Constitution.

 People falling in the category of senior citizens.

 People who are 60 years of age or older are included in the category of senior citizens.

 Maintenance of the elderly.

 Parents, if a case is going on in the tribunal regarding the elderly, then this tribunal decides how much money the elderly will have to give as maintenance to their children or relatives. Generally, a provision of giving a maximum of ten thousand rupees has been made.

 Complaint about quarreling with elderly parents.

 In case of a fight with parents, a complaint can be made to the police and for this, a case is registered under 151 IPC.

 Note: If a senior citizen who is a citizen of India but lives outside the country, he can also use this Act.
